1. Definitions
In these general terms and conditions, hereinafter referred to as: “General Terms and Conditions”, the following definitions apply:
1. Game Intelligence: Game Intelligence B.V. located at Sportlaan 71 in Uithoorn.
2. “Participant”: the natural person who, pursuant to the Agreement between
Game Intelligence B.V. and the Client, uses the services of Game Intelligence in the capacity of participant
3. “Agreement”: an agreement between Game Intelligence B.V. and the Client regarding one or more services to be provided by Game Intelligence B.V. for the benefit of the Client and Participant.
4. “Registration Form”: form that is part of the brochure and the website “www.Gameintelligencehockeyschool.nl” of Game Intelligence B.V.
5. “Contractor”: This refers to Game Intelligence B.V.
6. “Client”: the natural or legal person who enters into the Agreement with Game Intelligence B.V.
7. “Event”: This includes all offered activities of Game Intelligence. (Training sessions, Clinics, and Seminars)
2. Applicability
1. These General Terms and Conditions apply to all offers made by Game Intelligence, order confirmations, and resulting or related agreements or further agreements.
2. The applicability of any general (or specific) terms and conditions or clauses of the Client is expressly rejected by Game Intelligence.
3. Deviations from or additions to the Agreement or the General Terms and Conditions in any form are only valid if Game Intelligence has agreed to them in writing.
4. In the event of a conflict between the provisions of the General Terms and Conditions and/or provisions of the Agreement, the latter shall prevail.
5. Should any provision of these General Terms and Conditions not be applicable or be in conflict with Public Order or the Law, only the relevant provision will be considered as not written, and the remaining General Terms and Conditions will remain fully in force.
3. Conclusion of the Agreement
1. All offers from Game Intelligence are without obligation and subject to available capacity, unless expressly agreed otherwise.
2. The Agreement is concluded after the Client has fully completed the Registration Form on the website (www.gameintelligence.nl).
3. For telephone registrations, the Registration Form is completed by Game Intelligence on behalf of the Client. As a result, the same conditions apply as with a digital registration.
4. For registrations via the internet, there is a 14-day cooling-off period in connection with ‘distance selling’. Within this period, the registration may be cancelled free of charge without giving a reason, provided this is done in writing.
4. Costs
1. Unless otherwise stated, the prices shown by Game Intelligence in the quotes include VAT.
5. Payment
1. Payment of the required registration fee for the Training sessions is standardly made via direct debit.
2. Payment of other invoices must take place within 14 days of the invoice date
3. In the event of late payment, Game Intelligence reserves the right (regarding art. 5.2) to cancel the Agreement, and the Client is liable for the cancellation costs, taking into account the provisions of Article 8 paragraph 2 of the General Terms and Conditions.
6. Instructions and rules of conduct
1. The Participant is obliged to comply with all reasonable instructions from Game Intelligence to promote a proper execution of the Agreement. The Participant must also respect the rules of conduct that Game Intelligence wishes to see observed during the stay at accommodations under the Agreement.
2. A Participant who causes or may cause a nuisance or disturbance such that the proper execution of the Agreement by Game Intelligence is significantly hindered may be excluded by Game Intelligence. All resulting costs and damages will be borne by the Participant.
3. The Participant agrees that photos and videos taken during the hockey camp by (the staff of) Game Intelligence, featuring the recognizable image of the participant, may be used for potential promotional purposes. This includes trade journals, magazines, advertising purposes, website, etc.
7. Liability of Game Intelligence
1. All luggage and other personal property remain at the risk of the Participant at all times. Game Intelligence accepts no liability—except in the case of damage caused by intent or gross negligence of Game Intelligence—for damage to (valuable) items, luggage, and other personal property of the Participant, whether or not given into the custody of Game Intelligence staff, as a result of theft, loss, or damage.
2. Game Intelligence accepts no liability for damage for which a claim for compensation exists under travel and accident insurance or under (liability) insurance of third parties involved by Game Intelligence in the execution of the Agreement.
3. Game Intelligence accepts no liability for the transport of the Participant—except in the case of individual transport by Game Intelligence itself or except for intent or gross negligence of Game Intelligence. In such cases, the Participant must contact the relevant carrier.
4. Without prejudice to the provisions of the preceding paragraphs of this article, any liability of Game Intelligence is limited to the amount for which a claim exists in the relevant case under its (liability) insurance policy/policies.
8. Client Liability
1. The Client is jointly and severally liable for all damage that has arisen or will arise for Game Intelligence and/or any third party as a direct or indirect result of an attributable shortcoming—including non-compliance with the rules of conduct—by the Participant.
2. The Client will indemnify Game Intelligence against claims from third parties for compensation for damage arising from or related to the Participant’s use of facilities and/or services under the Agreement.
9. Force Majeure/Modification/Cancellation by Game Intelligence
1. If Game Intelligence is prevented in whole or in part by force majeure from fulfilling one or more of its obligations arising from the Agreement, Game Intelligence is entitled to offer what it considers to be an equivalent alternative or to have the Agreement dissolved in whole or in part without judicial intervention, without being held to any compensation towards the Client.
2. Force majeure as referred to in paragraph 1 of this article also includes:
a. Insufficient registrations for participation in an Event. This is the case if the number of registrations is less than 70% of the maximum number of participants per event as stated in the Game Intelligence brochure or website Gameintelligencehockeyschool.nl
b. Unavailability of the location due to, for example, fire, burglary, storm, or rain damage, snow, or frost
c. Illness of a large part of the staff (e.g., flu epidemic)
10. Cancellation by Client
1. Up to 14 days after registration, cancellation is possible free of charge even without ‘cancellation risk buyout’, unless:
2. If the Client chooses to cancel the training/seminar more than 14 days after registration, the following costs will be charged:

4. Obligations of Game Intelligence upon cancellation
6. In case of cancellation, the Participant is entitled to have another person substituted in their place. This will be seen as a ‘change’, see article 9.
7. Cancellation risk buyout
It is possible to buy out the cancellation risk for a fee of €25.00 regarding the indoor registration (= incl. €10 administration costs); this can be concluded up to a maximum of 10 days after registration, but no later than 14 days before the start of the indoor training sessions.
Payment is only granted upon cancellation before the start of the camp if one of the following circumstances occurs:
– Death, serious illness, or serious accidental injury of the Participant, 1st or 2nd-degree relatives, or housemates of the Participant.
– A medically necessary procedure that the Participant or a partner living with them may unexpectedly undergo.
– An injury such that the Participant cannot participate in the hockey activities in any way. A doctor’s note is required for this.
Payment is granted upon cancellation or interruption of the training period (indoor), based on a proportional reimbursement of the training period (indoor), for the number of full, unused days, if the Participant is affected by illness, an accident, or a serious injury during the training sessions.
Exclusions
Game Intelligence provides no coverage in the case of damage directly or indirectly related to civil unrest, which includes armed conflict, civil war, uprising, domestic disturbances, riots, mutiny, and terror.
11. Lost property
Lost property will be kept by Game Intelligence for three days after an Event. After this period, Game Intelligence is entitled to transfer these items to the Salvation Army or another charity.
13. Participant Insurance
The Client and/or Participant is obliged to take out accident insurance with sports coverage for the Participant during the period of the training sessions. If you are a member of a hockey club, you are insured through the hockey club and the conditions of the KNHB. You must check this yourself with the participant’s hockey club to ensure this is correctly arranged.
14. Applicable law and disputes
1. The Agreement and all agreements resulting from it are exclusively governed by Dutch law.
2. All disputes that may arise as a result of the Agreement or agreements resulting from it between parties will be settled by the competent judge of the court in Utrecht.
